1. Scope of Agreement
1.1
Welcome to YcDrama (hereinafter referred to as the “Mini Program”).
This User Agreement (hereinafter referred to as the “Agreement”) applies when you access, browse, register for, log in to, view, add to favorites, search, purchase, top up, unlock, subscribe to, comment on, participate in activities through, or otherwise use, via the TikTok platform, the short drama content, digital content services, membership benefits, virtual points, ad-unlocking services, customer support, and related features provided by YcDrama.
1.2
YcDrama is operated by Hong Kong Chincarcar Technology Co., Limited (hereinafter referred to as “we,” “us,” or the “Company”).
TikTok may provide the Mini Program with services including, but not limited to:
-Platform operating environment;
-User-authorized login;
-Payment capabilities;
-Advertising services;
-Technical support;
-Platform review and security capabilities.
Your use of the TikTok platform is also subject to TikTok’s applicable Terms of Service and Privacy Policy.
Unless otherwise provided by law or required by TikTok platform rules, the rights and obligations arising between you and Hong Kong Chincarcar Technology Co., Limited in connection with YcDrama content services, purchases of digital content, membership benefits, customer support, and other related matters are governed by this Agreement.
1.3
When you:
-Click “Agree”;
-Log in to or authorize the use of the Mini Program;
-Browse or watch short dramas;
-Purchase digital content;
-Use membership or points benefits;
you acknowledge that you have read, understood, and agreed to this Agreement.
If you do not agree with any part of this Agreement, please stop using YcDrama.
2. TikTok Account Authorization and User Account
2.1
You may log in to YcDrama using the authorization feature provided by TikTok.
After obtaining your authorization, we may receive information provided to us by the TikTok platform, including your TikTok user identifier, nickname, profile picture, authorization status, scope of authorization, and any necessary account information returned by the platform.
The above information is used to create or identify your YcDrama user account, provide viewing services, save your viewing history, and manage your purchased benefits.
2.2
We will process the information provided by TikTok only within the scope of your authorization and in accordance with applicable legal requirements.
If additional information needs to be collected, we will obtain the necessary authorization in accordance with applicable laws, platform rules, and the requirements of the Privacy Policy.
2.3
You are responsible for properly safeguarding your TikTok account and your access rights to YcDrama.
Viewing activities, purchases, unlocking activities, membership activation, and customer service communications carried out through your account will be deemed to have been performed by you.
If you discover any abnormal use of your account, you should promptly contact us at: yckjdrama@outlook.com.
2.4
Users may apply to cancel their YcDrama account by contacting us through our customer service email.
After receiving an account cancellation request, we will process the account within a reasonable period and delete, anonymize, or retain relevant information in accordance with applicable legal requirements.
After the account is cancelled:
-The user will no longer be able to access the cancelled account;
-Viewing history, favorites, and certain service features associated with the account may not be recoverable;
-Digital content benefits that have already been purchased and delivered will not automatically become eligible for a refund solely as a result of account cancellation, unless otherwise provided by law.
3. Service Content
3.1
YcDrama mainly provides the following services: short drama browsing, episode playback, episode search, favorites management, viewing history, playback progress synchronization, single-episode purchases, full-series unlocking, membership subscriptions, virtual points/coins services, ad-viewing unlocks, promotional benefits, and user support services.
3.2
Specific service content, including but not limited to drama titles, number of episodes, update schedules, playback regions, subtitle languages, prices, membership benefits, and unlocking rules, is subject to the information actually displayed on YcDrama pages.
3.3
Due to changes in content copyright licenses, adjustments to platform rules, technological upgrades, legal and regulatory requirements, or changes in operational arrangements, we may adjust certain content, features, or benefits.
If such adjustments affect benefits already purchased by users, we will take reasonable measures to the extent required by law.
3.4
Because short drama content may be affected by copyright license periods, regional restrictions, legal and regulatory requirements, or other operational factors, certain content may be adjusted, suspended, or discontinued.
If the above adjustments affect digital content benefits that users have already purchased but have not yet fully used, we will take reasonable measures to the extent required by applicable law, including but not limited to:
-Providing replacement content;
-Extending the period of use;
-Providing other reasonable compensation;
-Processing refunds as required by law.
4. Content Copyright and Intellectual Property
4.1
The short drama content, video files, posters, covers, titles, subtitles, dubbing, music, trademarks, page designs, software code, and related intellectual property rights in YcDrama are owned by Hong Kong Chincarcar Technology Co., Limited or the relevant rights holders.
4.2
Without the written permission of us or the relevant rights holders, you may not download, copy, make and distribute screen recordings of, commercially use, upload to other platforms, edit and distribute, sell, rent, publicly play, or otherwise use any relevant content in a manner that infringes the applicable intellectual property rights.
4.3
You may not use plug-ins or automated scripts, scrape content, bypass payment restrictions, circumvent or crack technical measures, create fraudulent viewing data, or maliciously obtain benefits.
If any of the above conduct is discovered, we have the right to restrict account features, suspend services, cancel improperly obtained benefits, preserve relevant evidence, report the matter to TikTok or relevant authorities, and pursue legal liability in accordance with law.
5. Paid Services, Membership, Virtual Points, and Digital Content Delivery
5.1 Scope of Paid Services
YcDrama may provide the following paid services: single-episode short drama unlocking, full-series unlocking, membership subscriptions, virtual points, coins or credits, limited-time promotional activities, and other digital content benefits.
The specific price, service period, benefit content, applicable scope, and purchase rules are subject to the information actually displayed on the purchase page.
5.2 Purchase Confirmation
Before purchasing any paid service, please carefully confirm the product name, price, quantity, service period, usage rules, automatic renewal rules (if applicable), and refund rules.
By completing payment, you confirm that the purchase information is correct and authorize us to provide the corresponding digital content or service benefits in accordance with the order.
When purchasing digital content or membership services, you confirm that:
You understand the name, price, service period, and benefit content of the product being purchased;
You request that we begin providing the digital content service immediately;
After the digital content begins to be provided, you may no longer be entitled to certain rights to cancel the order or obtain a refund under applicable law.
5.3 Immediate Delivery of Digital Content
The short drama content, membership benefits, virtual points, and other digital content provided by YcDrama constitute digital services.
After you purchase and begin using the relevant digital content, including but not limited to playing purchased episodes, unlocking episode content, using membership benefits, or consuming virtual points, you acknowledge that we have begun performing our obligations to provide the digital content service.
To the extent permitted by applicable law, you understand and agree that, due to the immediate delivery nature of digital content, after the digital content begins to be provided, you may no longer be entitled to certain statutory rights of withdrawal or cooling-off period rights.
5.4 Virtual Points and Digital Benefits
If YcDrama provides virtual points, coins, or similar benefits, such virtual benefits may only be used for designated services within YcDrama;
they are not currency;
they have no cash value;
they cannot be exchanged for cash;
and they cannot be transferred, sold, or gifted.
Unless otherwise provided by law, virtual benefits may not be used on other platforms or services.
If virtual benefits are granted through promotional activities, their specific validity period is subject to the information displayed on the applicable activity rules page.
If virtual benefits are purchased, such benefits will remain in the user’s account while the account remains valid, unless otherwise provided by law or in the event of service termination.
If the account is cancelled, terminated due to a violation of this Agreement, or subject to legal or regulatory requirements, the relevant virtual benefits may no longer be available for use.
5.5 Automatic Renewal
If YcDrama provides automatic-renewal membership services, we will clearly display the subscription period, charge amount, billing time, automatic renewal rules, and cancellation method on the purchase page.
You authorize us to automatically charge the fee for the next subscription period in accordance with the subscription rules after the current membership period ends.
You may cancel automatic renewal using the methods provided by the TikTok platform, the payment channel, or the account settings page.
After cancellation is successfully completed, your membership benefits for the period already paid for will not be affected, and fees already paid will generally not be refunded, unless otherwise provided by law.
5.6 Taxes
Depending on the legal requirements of your country or region, your purchase price may already include applicable taxes, or you may be required to pay applicable taxes separately.
You agree to bear the relevant tax obligations in accordance with applicable law.
6. Refund Policy
6.1
Refund rules will be determined based on the following factors: applicable law, TikTok platform payment rules, payment channel rules, the actual circumstances of the order, and the delivery status of the digital content.
6.2
To the extent permitted by law, if the digital content has not yet been provided, cannot be provided due to reasons attributable to us, or has material service defects, you may apply for a refund in accordance with the applicable rules.
6.3
Refunds are generally not supported in the following circumstances:
-The digital content has already been successfully delivered;
-The user has already watched or used the relevant content;
-The user has voluntarily consumed membership benefits or virtual points;
-The user has voluntarily unlocked episode content;
-The user is unable to watch normally due to the user’s device or network environment;
-The service has been restricted due to the user’s violation of this Agreement.
This does not apply where a refund is required by law.
6.4
Users applying for a refund must submit the application through the TikTok payment channel or YcDrama customer service channel.
Users may be required to provide: order information, account information, the reason for the refund, and relevant supporting documentation.
We will process the refund application within a reasonable period in accordance with applicable law and platform rules.
7. Ad-Unlocking Services
7.1
YcDrama may provide services through which users can obtain free viewing access, episode unlocking, virtual points, activity rewards, or other benefits by watching advertisements.
7.2
Users are required to complete the advertisement viewing in accordance with the instructions displayed on the page.
If the advertisement is not fully played because the user voluntarily exits, or due to network abnormalities, TikTok client abnormalities, or device issues, the relevant benefits may not be granted.
7.3
It is prohibited to obtain advertising benefits through any of the following methods: automatic clicking tools, emulator cheating, fraudulent traffic, script programs, or exploitation of technical vulnerabilities.
We have the right to cancel benefits obtained through improper methods.
7.4
Advertising content may be provided by third-party advertising service providers.
Unless otherwise provided by law, we are not responsible for third-party services relating to goods, services, links, or commercial information contained in third-party advertisements.
8. User Conduct Rules
You may not use YcDrama to publish illegal content; disseminate pornographic, violent, hateful, or fraudulent content; infringe the intellectual property rights of others; infringe the privacy of others; interfere with platform operations; attack servers; maliciously manipulate traffic; manipulate ratings; or bypass security measures.
If any violation is discovered, we may take measures including deleting relevant content, restricting features, suspending accounts, cancelling benefits, preserving evidence, and reporting the matter to the TikTok platform or relevant authorities.
9. Protection of Minors
9.1
YcDrama does not provide registration, purchase, or paid services to children who have not reached the minimum age required by applicable law in the user’s country or region.
If applicable law requires the consent of a parent or guardian, the user must ensure that such authorization has been obtained.
9.2
Minors purchasing memberships, virtual points, or digital content must obtain authorization from a parent or guardian.
9.3
If a guardian discovers that a minor has made an unauthorized purchase, submitted personal information, or used inappropriate content, the guardian may contact us at yckjdrama@outlook.com.
10. Service Changes, Interruptions, and Termination
10.1
Due to changes in copyright licensing, adjustments to TikTok platform rules, system maintenance, network failures, legal or regulatory requirements, force majeure, or other reasons, YcDrama may suspend, adjust, or terminate certain services.
10.2
We will make reasonable efforts to ensure the stable operation of the services.
However, we do not guarantee that the services will remain permanently uninterrupted, be free from all technical errors, or be compatible with all devices and network environments.
10.3
If a user violates this Agreement, violates laws or regulations, compromises platform security, or engages in fraudulent conduct, we have the right to suspend or terminate the services.
11. Disclaimer and Limitation of Liability
11.1
To the extent permitted by law, we will not be liable beyond the extent required by law for losses caused by any of the following circumstances: network failures, device issues, TikTok platform service abnormalities, third-party payment abnormalities, advertising service abnormalities, the user’s own actions, or force majeure.
11.2
If a user violates this Agreement, laws or regulations, or third-party rights, thereby causing losses to Hong Kong Chincarcar Technology Co., Limited, TikTok, or other third parties, the user will bear liability in accordance with law.
12. Privacy and Personal Information Protection
For information on how we collect, use, store, and protect your personal information, please refer to the YcDrama Privacy Policy.
The Privacy Policy forms an integral part of this Agreement.
We will process your personal information in accordance with the privacy and data protection laws applicable in your country or region.
13. Updates to the Agreement
13.1
We may update this Agreement due to changes in law, TikTok platform requirements, changes in product features, or business adjustments.
13.2
In the event of material amendments, we will notify users through Mini Program announcements, pop-up notices, page notifications, or other means.
13.3
Your continued use of YcDrama constitutes your acceptance of the updated Agreement.
14. Governing Law and Dispute Resolution
14.1
This Agreement, including its formation, validity, performance, interpretation, and dispute resolution, shall be governed by the laws applicable in your country or region to this Agreement and the related services.
14.2
If the laws of your country or region grant you consumer protection rights that cannot be excluded or restricted, those mandatory legal protections shall remain unaffected by any provision of this Agreement.
14.3
Any dispute arising out of or in connection with this Agreement shall first be resolved through friendly consultation between the parties.
If the dispute cannot be resolved through consultation, either party may bring proceedings before a court of competent jurisdiction in your country or region, unless applicable law provides otherwise.
